Terms & Conditions.
Effective October 23, 2026. These terms cover the werelentless.com website and, when expressly incorporated into an accepted written order or services agreement, commercial equipment and facility services supplied under the Relentless Strength name. Relentless Strength was founded by Tony Chowdhury and is also referred to as “Relentless,” “we” or “us.” “Client” means the business purchaser or commissioning party. The contracting legal entity and its address must be identified in the accepted order or agreement.
1. B2B scope and agreement
Our commercial offerings include plate-loaded and pin-loaded strength equipment, custom rigs, specialised turf and sports courts, rubber flooring and 2D/3D facility layouts. A representative placing an order for a business must have authority to bind it. Consumer rights and other mandatory legal protections remain applicable wherever they cannot lawfully be excluded.
Submitting a brief, selecting equipment, requesting a quote, downloading a document or receiving an automatically generated document labelled “Invoice” does not by itself place an order, create a payment obligation or form a purchase contract. A purchase or paid service requires an accepted written quote, order confirmation or services agreement identifying the scope, price and applicable terms (“Order”). These B2B sale and service provisions apply only when the Client accepts them as part of that Order. Posting this page alone does not amend an existing signed contract.
An expressly negotiated and accepted Order provision prevails over a conflicting provision here; otherwise these terms apply where incorporated. Product-specific express warranties retain their stated coverage. Client purchase-order boilerplate does not alter an accepted agreement unless we expressly accept the change in writing. Changes to this page apply prospectively and do not rewrite previously accepted Orders.
2. Quotations, payments and changes
Quotes are subject to their stated validity period, specifications and written acceptance. Confirm quantities, model and configuration, finish, dimensions, accessory scope, taxes, duties, freight, unloading, installation and site works before ordering. Website illustrations and indicative specifications do not replace the accepted Order. We do not collect checkout payments on this website.
Deposits, milestones, balance payments and any financing arrangements are those stated in the Order. Manufacturing and dispatch may depend on required payments, approved drawings and confirmed specifications. Any suspension for non-payment must follow the Order and applicable law. A promotional or discount reference is subject to its disclosed offer terms and the final written quotation; marketing consent is optional.
Changes to approved layouts, colours, quantities, branding, dimensions, materials or installation conditions require a written change order confirming price and schedule effects before the changed work proceeds. We are not required to absorb additional work or expedited costs caused by Client changes, inaccurate supplied information or undisclosed site conditions. No material substitution is authorised merely by these terms.
3. Concept layouts and professional verification
Free 2D and 3D gym layouts, renders and walkthroughs are preliminary architectural concepts for equipment placement, visualisation and circulation planning only. They are not permit drawings, structural calculations, sealed architectural or engineering documents, construction instructions or a certification of code compliance. Professional architectural or engineering services are included only under a separate written scope delivered by appropriately licensed professionals.
Before ordering, fabrication, construction or installation, the Client must arrange verification of measurements, structural and floor loads, slab and anchor suitability, utilities, ceiling heights, accessible routes, equipment clearances, local zoning, occupancy, fire and life safety, egress and all applicable codes. Use a locally licensed contractor and the licensed architect or structural engineer required for the work; contractor review alone does not replace a legally required engineering analysis or stamped approval. The authority having jurisdiction makes permitting and occupancy decisions.
The Client is responsible for accurate plans and information, site access, landlord approvals, permits and the required independent professional review. Concept approval does not make an unverified condition safe. Do not scale a rendering for construction or treat a visual clearance as a certified measurement. Relentless remains responsible for any express obligation it accepts in an Order and for duties that law does not allow it to disclaim.
4. Site readiness, flooring, courts and installation
Unless expressly included in the Order, installation excludes demolition, structural reinforcement, electrical or plumbing work, substrate repair, moisture mitigation, levelling, drainage, hazardous-material removal and permit fees. The Client must provide safe access, suitable unloading facilities, accurate dimensions, a secure work area and a substrate meeting the agreed product and installation requirements.
Rubber flooring, turf, adhesives and sports courts may require substrate tests, suitable temperature and humidity, acclimation, curing and limits on early use. The Client must follow the written installation, maintenance and use instructions and keep users away until the responsible installer releases the area. Existing moisture, unevenness, contamination or hidden conditions can require revised scope and schedule. We may pause unsafe or unready work, subject to the Order; additional documented costs require an agreed contractual basis.
5. Schedules, freight delays and opening dates
Manufacturing, dispatch, freight, installation and completion dates are estimates unless the accepted Order expressly identifies a binding deadline and its agreed remedy. Site copy describing typical lead times is not an opening-date guarantee. Schedules depend on payments, approvals, customisation, material availability, carrier capacity, customs clearance and site readiness.
To the fullest extent permitted by law, Relentless Strength is not financially liable for a delayed gym opening or reopening, construction-delay charges, lost memberships, lost profits or revenue, idle staff, rent, financing costs, lost bookings, substitute facilities, or penalties owed to the Client’s landlord, contractor, lender or customers arising from freight or shipping delays, logistics interruptions, design revisions, production rescheduling or installation changes. This exclusion applies even if an opening date or the possibility of such losses was communicated to us, and is subject to the mandatory-law exceptions in Section 10.
The Client must allow reasonable contingency time and coordinate contractors and opening commitments accordingly. We will communicate material schedule changes when known and use commercially reasonable efforts to mitigate delays within our control. A delay does not automatically cancel an Order; agreed cancellation rights and mandatory legal remedies remain available.
6. Heavy freight delivery and international shipments
Commercial equipment may arrive in crates or on pallets by heavy freight. Delivery is to the location and service level stated in the Order. Unless expressly included, freight does not include inside delivery, stairs, cranes, rigging, forklifts, liftgate service, unpacking, assembly, anchoring, debris removal or installation. The Client must disclose access restrictions, receiving hours and equipment needed before shipment, arrange a responsible receiving representative and ensure safe unloading by qualified personnel.
Storage, detention, failed-delivery, redelivery or special-handling costs caused by inaccurate delivery instructions, unsafe access or the Client’s failure to receive may be charged to the Client to the extent documented and permitted by the Order. Carrier tracking is not a guaranteed appointment.
The Order governs transfer of title and risk, insurance, freight charges and responsibility for claims. Any Incoterms rule must be expressly named with its version and named place. If the Order is silent, applicable law governs; these terms do not silently create an EXW or FOB shipment. For cross-border shipments, the Order must identify the importer of record and responsibility for customs, duties, import taxes, certifications and destination requirements. No blanket promise of compliance with every country’s equipment or building standards is made.
7. Inspection, shipping damage and defects
Inspect the delivery promptly. Record visible damage, missing packages and discrepancies on the delivery receipt before signing where reasonably possible, photograph the shipment and packaging, and notify Relentless Strength in writing within 48 hours after delivery of visible shipping damage, shortages or manufacturing defects reasonably discoverable during an ordinary receiving inspection. Send your order number, delivery date, carrier details, serial numbers if available, photographs and a clear description to ceo@fusiongyms.com.
Retain packaging and affected parts for inspection. Do not use unsafe or damaged equipment or arrange disposal, return freight or non-emergency repairs without coordination. Take reasonable steps to prevent additional harm. A delivery signature does not by itself waive a concealed-defect claim.
The 48-hour notice is an operational inspection requirement, not an absolute expiry of warranty or statutory claims. Report a concealed manufacturing defect or concealed damage promptly after discovery, within the applicable warranty and legal notice periods. Late notice may affect recovery only to the extent legally permitted and supported by actual prejudice, such as lost carrier evidence. Nothing here reduces a mandatory carrier-claim or lawsuit deadline. For qualifying U.S. interstate motor-carrier claims, applicable federal law may require at least nine months to file a claim and two years to sue after written disallowance; the bill of lading and applicable law must be checked.
Notice to Relentless does not automatically file a formal carrier claim. The party responsible under the Order must preserve and file that claim, with reasonable cooperation from the other party. Freight damage and a manufacturing defect may involve different responsible parties and remedies.
8. Warranty, remedies, cancellations and returns
The applicable written product warranty and accepted Order govern coverage, eligibility, duration, parts, labour and approved claim procedures. Published express warranty commitments that legally form part of the bargain are not withdrawn by this page. Review the warranty FAQ and obtain the product-specific terms before ordering. No new blanket warranty duration is created here.
For a covered defect, our obligation is the repair or replacement remedy stated in the applicable warranty. If that exclusive remedy cannot be provided within a reasonable time or fails its essential purpose, the remedies required by applicable law remain available. Unless the warranty, Order or law provides otherwise, unauthorised modifications, misuse, improper installation, inadequate maintenance and normal wear are not manufacturing defects. Confirm responsibility for parts, labour and transport before arranging service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCEPT FOR EXPRESS WARRANTIES THAT APPLY TO THE ORDER, RELENTLESS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER DOES NOT NEGATE AN EXPRESS WARRANTY OR ANY WARRANTY THAT CANNOT LAWFULLY BE EXCLUDED.
Custom-manufactured, made-to-order and branded items are not cancellable or returnable for convenience unless the accepted Order or a later written authorisation permits it. Any cancellation charges must have a contractual basis and reflect lawful, reasonable costs or damages without double recovery. Returns require written instructions and authorisation; do not ship goods back without arrangements. This restriction does not eliminate remedies for covered defects, nonconforming goods or other mandatory rights. See Orders, cancellations & returns.
9. Intellectual property and confidential project materials
Relentless Strength retains exclusive ownership, as between Relentless and the Client, of its original proprietary equipment aesthetics, custom rig blueprints, layout systems, branding guidelines, visual content, drawings, models, methods and other intellectual property that it owns or develops, except for any rights expressly assigned in a signed agreement. The website’s publication or a project fee does not itself transfer copyright, design rights or manufacturing rights.
This ownership statement does not claim a supplier’s pre-existing equipment design, third-party photograph or licensed asset, a Client’s pre-existing brand or submitted concept, or ideas and functional features not protected by law. Those rights remain with their respective owners. Client-specific ownership or licensing agreed in a signed document takes priority.
Subject to the applicable Order, payment obligations and professional-verification requirements, we grant the Client a limited, non-exclusive permission to use supplied project concepts for evaluating and coordinating the identified facility with its advisers and contractors. This does not permit reproducing equipment, manufacturing from our rig blueprints, reselling designs or using them for unrelated sites. Additional implementation or reproduction rights require written agreement.
The Client retains its submitted materials and grants us only the permission reasonably needed to evaluate, quote and perform the requested work, including necessary confidential coordination with providers. The Client warrants it has authority to supply those materials. We will not sell proprietary Client concepts or use confidential Client plans for public marketing without permission. Confidentiality does not cover information independently developed, lawfully received elsewhere or already public without breach; legally compelled disclosure is limited to what is required.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RELENTLESS STRENGTH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL COMMERCIAL DAMAGES, INCLUDING LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL OR ANTICIPATED SAVINGS, BUSINESS INTERRUPTION, LOSS OF USE, OR DELAY-RELATED LOSSES DESCRIBED IN SECTION 5, WHETHER ASSERTED IN CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), WARRANTY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.
SUBJECT TO THE EXCEPTIONS BELOW, RELENTLESS STRENGTH’S TOTAL AGGREGATE LIABILITY ARISING FROM AN ORDER IS LIMITED TO THE AMOUNTS PAID OR PAYABLE TO RELENTLESS FOR THE PARTICULAR GOODS OR SERVICES DIRECTLY GIVING RISE TO THE CLAIM. FOR A FREE CONCEPTUAL LAYOUT PROVIDED OUTSIDE A PAID ORDER, THE AGGREGATE CAP IS US$100, BUT ONLY WHERE THESE TERMS WERE EXPRESSLY ACCEPTED FOR THAT SERVICE.
These limitations do not exclude or limit liability for fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is prohibited, or any other non-excludable duty, statutory remedy or liability. They do not remove an obligation to return unearned payments where an agreed or legally required refund is due. The exclusion of consequential commercial losses is intended as an independent allocation of risk, to the extent enforceable, even if a separate limited remedy fails.
The parties must take reasonable steps to mitigate loss. These provisions allocate commercial risk in light of the price and scope; they are not a representation that every exclusion is enforceable in every jurisdiction.
11. Client operations and third-party claims
The Client is responsible for qualified assembly and anchoring where not included in our scope, regular inspection and maintenance, user instruction and supervision, safe access and compliance with operating requirements. Never operate equipment beyond its specified purpose or rated capacity.
To the extent permitted by law, the Client will indemnify Relentless against third-party claims and reasonable costs to the extent caused by the Client’s unlawful instructions, unauthorised use of third-party intellectual property in supplied materials, or negligent or wilful misuse, alteration or installation by the Client or its contractors. This does not cover the portion caused by Relentless’s negligence, defective products, breach or other wrongdoing. Relentless must give prompt notice and reasonable cooperation; the Client may control the defence with competent counsel, but may not impose an admission or non-monetary obligation on Relentless without consent.
12. Events beyond reasonable control
Neither party is responsible for failure or delay caused by events beyond its reasonable control, such as natural disasters, war, embargoes, government restrictions, widespread transport disruption or utility failure, to the extent the event actually prevents performance and reasonable mitigation is unavailable. The affected party must give prompt notice and seek to reduce the impact. A lack of funds alone is not such an event, and amounts already due remain payable. The Order and applicable law govern extensions, suspension, termination and any refund for unperformed work.
13. Relentless Strength SMS Terms & Conditions
Our optional informational program covers equipment enquiries, quotes, project updates, appointment reminders, orders and delivery coordination. A separate promotional program covers equipment news, discounts and offers. “Relentless” in our forms refers to Relentless Strength.
You must be 18 or older and own or be authorised to use the supplied telephone number. Select the relevant unchecked SMS choice on the enquiry, discount or applicable lead form to opt in. You may choose either program, both or neither. Permission is not required to purchase, request a quote or claim an offer. Providing a number alone is not consent, and accepting these Terms is not SMS consent.
Message frequency varies. Message and data rates may apply to messages sent and received. Contact your wireless provider about your plan. Carriers are not liable for delayed or undelivered messages.
Reply STOP to unsubscribe at any time. You may receive one confirmation; further program texts will stop. Rejoin by submitting a new opt-in. Reply HELP for assistance or email aidan@fusiongyms.com. Notify us if you relinquish or change the number. Opting out does not cancel your equipment enquiry or Order. Our Privacy Policy describes information handling, and mobile information and SMS consent are not shared for third-party marketing.
14. Website use, law and remaining terms
Do not submit unlawful material, impersonate another business, disrupt the site or attempt unauthorised access. Website renders and samples illustrate options and may differ from final agreed specifications. We may correct errors and maintain the site, but cannot retroactively alter an accepted Order merely by editing a page.
Where these terms are incorporated into an Order, Pennsylvania law governs, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods, unless the Order provides otherwise or mandatory law requires another result. The Order should specify any agreed dispute forum. No arbitration obligation, class-action waiver or shortened lawsuit deadline is imposed by this page.
If a provision is unenforceable, the remaining provisions continue to the extent lawful; any narrowing must stay within what the law permits. A failure to enforce once is not a permanent waiver. Provisions intended to survive completion, including confidentiality, payment obligations, intellectual property and enforceable liability limitations, survive. Nothing here waives mandatory privacy, consumer, product-safety or carrier rights.
